Terms and Conditions

We will refer to ‘Marine Audio Visual Ltd’ as well as the abbreviated ‘MAV’ as one of the same.

PRICE

Unless stated, all prices are in Great British Pounds (£ GBP). The total cost of your order will be the price of the products, the delivery charge (if any), plus any additional services you choose e.g. premium delivery, delivery to a residential address or delivery to addresses outside of the UK mainland (such as Republic of Ireland or Isle of Man etc.).

We will charge VAT on all UK sales at standard rates.

We will also charge VAT on all EU sales unless you have supplied a valid VAT number.

We retain the right to adjust pricing without notice to reflect cost changes beyond our immediate control e.g., carriage charges, exchange rate variations, your special shipping requirements etc. Where possible we will give notice of the price changes and on a case-by-case basis will review outstanding quotes / pro forma invoices.

QUOTATIONS

Quotations are valid for a period of 30 days only, unless otherwise stated on the document. After the 30 days have expired, please contact the sales team to obtain correct pricing / specification etc.

Our Estimates to not include any electrical, building, joinery or redecorating of any kind. 

DELIVERY

We do everything we can to ensure your order arrives at your door complete and in pristine condition. We will provide tracking where necessary and in the unlikely event that the product is damaged or faulty, please contact us as soon as possible.

If the product is damaged when it arrives, please either sign for the goods as damaged or refuse the delivery and then contact us as soon as possible on +44 (0) 7545424244.

We endeavour to have goods delivered promptly and in accordance with advised lead times, but accept no liability for costs incurred as a result of delays in delivering goods or if you sign for the goods as acceptable and then later find they are damaged, we will not be able to refund or exchange the items.

LIABILITY

Marine Audio Visual Ltd excludes liability for consequential, special or indirect damages, loss of profits and liquidated damages.

Marine Audio Visual Ltd will endeavour to carry out all aspects of the contract agreed but only warrants a performance standard no greater than reasonable care and skill.

RETENTION OF TITLE

Marine Audio Visual Ltd shall retain title to the goods until we have received payment in full for all sums due in connection with the supply of all goods to you at any time. If you fail to make payment to MAV when due, enter into bankruptcy, liquidation or a composition with your creditors, or have a receiver or manager appointed over all or part of your assets, Marine Audio Visual Ltd shall have the right, without prejudice, to these remedies:

To enter without prior notice any yacht, business premises owned or rented by you, where goods owned by Marine Audio Visual Ltd may be, and to repossess such items. We shall document any such repossession and credit your account as may be required.

We will also withhold delivery of any undelivered goods and stop goods in transit.

TRAVEL

Expenses for travel from Dorset will be charged at 45p (GBP) per mile from and to Dorset, United Kingdom unless specifically included in the quotation provided.  Expenses for accommodation will be charged at cost plus 10% unless provided or specifically included in the quotation.

PAYMENT TERMS

Until we agree credit facilities, we may request payment in advance for any or all transactions.

60% is payable with order

30% is payable upon practical completion

10% is payable once the project is complete and has been signed off with commissioning

We require a Purchase Order at time of commissioning and before our works can proceed.

We reserve the right to ask for full payment in advance in respect of orders for special products not normally stocked and therefore ordered in, specifically for you, e.g., customised screens, custom furniture, custom width or colour speakers etc.

We reserve the right to charge a fee not exceeding 1.5% for UK clients and 3% for overseas transactions on invoices exceeding £2,500 paid by debit/credit card. We will always advise you of this in advance.

We reserve the right to charge you in respect of bank costs incurred, because of cheque(s) returned unpaid.

RETURNS & RESTOCKING FEES

When we despatch products to you, we expect you to take delivery of them. If, for any reason, excepting any errors made by us, you ask us to take back products, and we agree, we reserve the right to charge a re-stocking/warehousing fee. This fee shall normally be up to 25% of the invoice price, together with the full value of any additional carriage charges as incurred by us and invoiced to us.

In the event that we supply you with new products and you return them to us after you have opened them, we shall assess the goods on return. If, by virtue of the condition of the goods we receive back, we cannot re-sell the goods as new products, we shall also reserve the right to charge a higher restocking fee than the above amount.

General returns, where product is not needed and unopened, shall be honoured within 14 days of delivery. Any items outside of this period shall be at the discretion of management.

Custom products purchased in error or unwanted may not be returned, unless the error is ours. However, without commitment, we shall work reasonably with you to resolve any difficulty where possible.

COMMISSIONING

All commissioning and handover shall include goods supplied as per our specification including software provided.  Items that are not in the specification or outside the scope of works may be provided at the discretion of MAV Engineers, but could be chargeable.

Marine Audio Visual Ltd, cannot be held responsible for any equipment or software not supplied by MAV and all hardware and software supplied will remain the property of Marine Audio Visual Ltd until paid in full.

Handover and commissioning shall compromise of all the functionality of the system specified.  Any changes outside of the quotation or specification will be confirmed in writing and may incur additional charges.

If there are any delays in our works programmed, MAV will have the right to charge a daily rate of £600 (GBP) per day, per engineer, plus expenses and VAT where applicable. These prices may be subject to change if overseas work is required.

We assume site working conditions are safe, clean and clear of any obstruction and we have uninterrupted access.  We will require 240-volt power and light.  

Marine Audio Visual Ltd. to be granted the facility access that will be required to complete a project in a workmanlike and timely manner.  Project cost and pricing are dependent upon a continual flow of work without interruption or delays imposed by MAV or their staff, construction, other building trades or any other party, and additional costs may be incurred by Marine Audio Visual Ltd.. If such delays result in additional costs that are not covered by the pricing of a proposal.

Any additional work or variation requirement must be requested and passed on to Marine Audio Visual Ltd.   No additional or varied works can be actioned until a signed order have been received by Marine Audio Visual Ltd.

Any work included within an order is not subject to the same schedule of works as the main contract and may result in extension being required on delivery.

A 40% handling charge will be applied to all items if the specification is changed once agreed and purchased for installation. Title to all delivered and/or installed equipment remains the property of Marine Audio Visual Ltd. until payment is received in full. It is the responsibility of the client and/or site manager to protect all equipment from damage and/or theft until project is completed.

WARRANTY

Goods supplied are covered by the manufacturer’s warranty for each particular product. Any faults occurring during the warranty period should be notified to us and we will take the appropriate action in conjunction with the manufacturer in order to get the fault resolved as quickly as possible.

Goods supplied my MAV will be new and excellent quality, free from defects.  If goods are found to be less than perfect condition, please notify us immediately to take appropriate action to resolve this.

Equipment not supplied by MAV or resulting in defects from other contractors/suppliers shall be exempt from the warranty.

Goods should (where possible) be returned in original packaging. Marine Audio Visual will accept no responsibility for any damages to goods that are sent/returned in non-original packaging. Customers are able to hand deliver goods to be serviced/replaced and if this is the case suitable packaging must be provided in the event that the goods require returning via a courier service.

Warranties are covered within the UK and Marine Audio Visual shall not be liable for any charges that arise from having to travel to sites that are outside of this.

Products supplied outside the UK may require the goods to be returned back to the manufacturer’s main warranty location at the expense of the client.  We will then notify you if the goods are replaced or repaired under warranty.

If a defect relating to the installation is found due to MAV’s workmanship or a change from the agreed specification caused by MAV, we reserve the right to correct the defect without being in breach of contract.  This would be carried out at the earliest and convenient time possible subject to the client’s location.

MANUFACTURER / SUPPLIER CLOSURES

In the unlikely event of a manufacturer / supplier closing down we will endeavour to continue supporting purchased items moving forwards.

Refunds of items purchased prior to the closure will be reviewed on a case-by-case basis if necessary.

DRAWINGS

CAD drawings are provided upon request and may be chargeable depending on how much MAV equipment is being supplied for the project. We also provide a free service which is not as in-depth as a full dedicated CAD of the actual room / site, as long as at least one MAV brand is included within the project. Please ask/specify before requesting a drawing.

All MAV services must be checked by the client prior to being issued or worked to. All CAD services must be covered by the clients own respective insurance policies. No claims, for any reason whatsoever, shall be made against Pulse Cinemas from the client or any other third party.

INSURANCE

Marine Audio Visual Ltd holds a professional indemnity insurance to the level of £10 million.

SECURITY

During installation, adequate security must be provided and any loss or damage of goods due to theft or damage by third parties is not the responsibility of Marine Audio Visual Ltd and will not be replaced or covered by MAV costs.
